Use of the website (hereinafter: the “Website”) of Eden Association – the Association for the Advancement of Educational, Social and Cultural Projects in the Northern Negev (Registered Association) (hereinafter: the “Association” or the “Organization”) is subject to these Terms of Use (hereinafter: the “Terms of Use”), which govern the relationship between the user (hereinafter: the “User”) and the Association.
The Association reserves the right to amend or update these Terms of Use from time to time, at its sole discretion and without prior notice. Any amended or updated terms shall become binding upon their publication on the Association’s Website.
Please read these Terms of Use carefully. By accessing or using the Website, the User acknowledges and agrees to be bound by these Terms of Use. If you do not agree to the Terms of Use set forth below, please refrain from using the Website in any manner.
The Website may contain, inter alia, professional information, professional publications, research, articles, media reports, recommendations and similar content. All information contained in such materials reflects solely the views of their respective writers, authors and/or editors. The Association makes no representation and assumes no responsibility regarding the correctness, reliability, accuracy, validity or quality of such information, any errors that may appear in the content, or any interpretation or use thereof.
Neither the Association nor anyone acting on its behalf shall bear any liability for any direct, indirect, consequential or special loss or damage of any kind arising out of or in connection with the use of this Website, including with respect to the Website’s content, form, nature, usefulness, benefits, potential disadvantages or damages, limitations, or suitability for the User’s needs, personal circumstances and/or purposes.
For the avoidance of doubt, use of and access to the Website are undertaken at the User’s sole discretion and responsibility. The User hereby waives any allegation, demand or claim against the Association that may arise from or in connection with the use of the Website.
Links from the Website to other websites or to information provided by any third party are made available solely for the User’s convenience. The inclusion of any such link does not constitute a representation that the content of the linked website is reliable, complete or current. Neither the Association nor anyone acting on its behalf bears or shall bear any liability for any direct, indirect, incidental or consequential loss or damage arising from or caused to the User as a result of being directed to such other websites or as a result of relying on any information displayed, provided or offered therein.
All copyrights and intellectual property rights in and to the Website, including, without limitation, all texts, materials, research literature, content, designs, software, computer applications, computer code, graphics, images, photographs, illustrations, animations, diagrams, lists, articles, data, media reports, video recordings, audio recordings, scripts, databases, information, transcripts, ideas, names, logos, symbols, icons, signs, trademarks, specifications and any other information of any kind or nature appearing on or relating to the Website (hereinafter: the “Content”), are the exclusive property of the Association and/or of the relevant rights holder who has authorized their use on the Website. No use may be made of any such Content, whether directly or indirectly, without the Association’s prior authorization.
Nothing in the foregoing shall impose any liability upon the Association with respect to information published by a third party in violation of the provisions set forth herein or in infringement of any intellectual property right. Furthermore, nothing in the foregoing shall impose any liability upon the Association for representations made to it by third parties regarding their proprietary rights in any information displayed on the Website.
The Website Content, or any information, software, products and/or services originating from the Website or its Content, may not be copied, reproduced, duplicated, distributed, displayed, uploaded, transmitted, published, updated, sold, modified or otherwise used, in any form or by any means, whether directly or indirectly.
Neither the Association nor anyone acting on its behalf warrants that the services provided through the Website will be uninterrupted, provided continuously or regularly, error-free, or protected against unauthorized access to the Website’s computer systems or against damage, corruption, malfunctions or failures affecting hardware, software, communication lines or communication systems, whether belonging to the Association or to any of its service providers.
Neither the Association nor anyone acting on its behalf shall be responsible for ensuring that its computer systems or the server through which the Website is operated are free of computer viruses, spyware or any other software that may damage the User’s or any third party’s computer equipment or the information stored thereon.
Any person submitting or publishing material on the Website (hereinafter: the “Contributor”) acknowledges that all material published on the Website or submitted by the Contributor to the Association is submitted under the Contributor’s sole responsibility. The Contributor shall bear sole responsibility for such information, hereby releases the Association from any liability in connection with information submitted by the Contributor, and waives any allegation or claim against the Association in connection with such information or its use.
The Contributor undertakes to ensure that all submitted material is appropriate and does not infringe any right of another person, including any intellectual property right. The Contributor shall not upload to or submit through the Website any unlawful material or act in any manner that may cause harm to the Association or to any third party.
The Contributor undertakes not to submit or publish any of the following:
- Threatening, racist or defamatory content; content encouraging the commission of criminal or civil offences; content infringing privacy; harmful content; content likely to offend public sensibilities; obscene content; or any other content that violates any applicable law;
- Content that infringes the intellectual property rights of any third party;
- Content containing computer viruses of any kind;
- Commercial advertising or content unrelated to the purposes of the Website.
Use of the Website shall constitute the User’s full and informed consent to the Privacy Policy. The User agrees and consents to the collection, use and disclosure of the User’s personal information as set forth below and in any privacy notice presented from time to time. If you do not agree to any provision of this Privacy Policy, you may choose not to use the Website.
The Association does not collect “Information” or “Sensitive Information,” as such terms are defined under the Israeli Protection of Privacy Law, 5741–1981 (collectively hereinafter: “Personal Information”), except for information required to identify the User and provide the requested services.
The Association may use the User’s Personal Information solely for internal purposes, for the provision of services and, where necessary, for communicating with the User. Nothing in the foregoing shall prohibit the Association from using information in aggregated and/or anonymized form.
The Association does not share the User’s Personal Information with third parties. Notwithstanding the foregoing, the Website operator may disclose such information where required to do so by law.
The User acknowledges and agrees that the Association may, from time to time, engage external service providers and that Personal Information may be transferred to such providers. External service providers shall be prohibited from using Personal Information for any purpose other than providing services to the Association, in accordance with these Terms of Use, this Privacy Policy, the Association’s procedures and the laws of the State of Israel.
The Website uses cookies for its regular and proper operation, including for the collection of statistical data regarding use of the Website, the verification of information, the customization of the Website and information-security purposes. A User who does not wish to accept cookies may prevent their use by changing the relevant browser settings and may delete cookies from the User’s device at any time.
Use of this Website shall be governed exclusively by the laws of the State of Israel. The courts of competent jurisdiction located in Beersheba, Israel, shall have sole and exclusive jurisdiction over any matter arising out of or in connection with the use of the Website.
These Terms of Use are drafted in the masculine form in the original Hebrew solely for convenience and apply equally to all genders. Any reference in the singular shall also include the plural, and vice versa.
